Terms and Conditions

These Terms and Conditions (“Terms”) govern the provision of services by TDS Waste Solutions (“TDS,” “we,” “us,” or “our”). By requesting, scheduling, or using our services, you agree to be bound by these Terms.
1. Services Provided
TDS Waste Solutions provides residential trash collection services within its designated service areas. Services are offered on a month-to-month basis with no long-term contract unless otherwise stated.
2. Customer Responsibilities
Customers agree to:
- Place trash containers in the agreed-upon location by the scheduled pickup time
- Ensure trash is properly bagged and does not exceed container capacity
- Comply with all local, state, and federal waste disposal regulations
- Avoid placing prohibited or hazardous materials in containers
3. Containers and Equipment
If TDS provides a trash container:
- The container remains the property of TDS Waste Solutions
- Customers are responsible for reasonable care of the container
- Containers must not be damaged, modified, or used for non-household waste
TDS reserves the right to repair or replace damaged containers at the customer’s expense if damage is due to misuse or negligence.
4. Billing and Payments
- Services are billed monthly unless otherwise specified
- Payments may be made via approved payment methods
- Customers are responsible for maintaining current and accurate billing information
5. Late Payments and Fees
- Late payments and payments returned for Insufficient Funds (NSF) will be subject to:
- $10 fee for the first occurrence within a 12-month period
- $25 fee for the second and subsequent occurrences within the same 12-month period
- Failure to pay incurred fees may result in service suspension 30 days after the fee is assessed
6. Non-Payment, Suspension, and Cancellation
- Service will be suspended after two (2) weeks of non-payment
- Service will be canceled after five (5) weeks of non-payment AND no communication with TDS regarding payment, payment arrangements, or intent to resume service
- If a TDS-provided container is on the property at the time of cancellation, TDS reserves the right to retrieve the container
Upon container retrieval:
- Any trash found in the container will be bagged and left on the customer’s property
- TDS is not responsible for disposal of trash left behind due to non-payment
7. Missed Pickups and Service Interruptions
TDS is not responsible for missed pickups due to:
- Improperly placed containers
- Overfilled or improperly prepared trash
- Blocked or inaccessible service locations
- Weather, road conditions, equipment failure, or events beyond reasonable control
Reasonable efforts will be made to resume service as soon as practicable.
8. Prohibited Materials
The following items are prohibited:
- Hazardous waste, chemicals, liquids, batteries, medical waste
- Construction debris, concrete, dirt, or large bulk items unless pre-approved
- Any material prohibited by law
TDS reserves the right to refuse service for prohibited materials.
9. Property Access and Liability
Customers grant TDS permission to access their property as necessary to perform services. TDS is not responsible for damage caused by:
- Pre-existing conditions
- Unmarked obstacles
- Normal wear associated with service access
10. Limitation of Liability
To the fullest extent permitted by law:
- TDS shall not be liable for indirect, incidental, or consequential damages
- Liability for any claim shall not exceed the amount paid for services during the prior three (3) months
11. Termination by Customer
Customers may cancel service at any time with reasonable notice. Outstanding balances must be paid prior to cancellation.
12. Changes to Terms
TDS reserves the right to modify these Terms at any time. Updated Terms will be posted on our website and will take effect upon posting.
13. Governing Law
These Terms shall be governed by the laws of the Commonwealth of Virginia.
